Spyder Air Ltd is the authorised UK distributor of Dyna Beads.
General
These terms and conditions govern the
supply of goods sold by Spyder Air Ltd to the Customer (you)
and constitute the
entyre and only agreement between us in relation thereto.
All orders placed are subject to acceptance by us by delivery of
the goods to you at which point a legally binding contract
is
constituted between us. The processing of your payment and
acknowledgement of your order does not constitute legal acceptance
of your order.
Price and Payment
We reserve the right to vary the quoted price and goods will
be invoiced to the purchaser at the prices ruling at the date
of dispatch unless otherwise agreed by the Company in writing.
Prices shown on the web site, flyers or magazine advertising
may not be the same as those shown or on display within the retail
store. Promotions available on the web site may not be available
in store or through the Mail Order service and vice versa.
We accept payment by most major credit, debit cards, Paypal
& cheque. Payment will be debited to your account before the
dispatch of your
purchase. We must receive payment for the whole of the price
of the goods you order, and any applicable charges for carriage,
before
your order can be processed unless we have agreed otherwise
in advance.
If you are an account customer, payment shall be
made in full
within 30 days of the invoice date. We
may revoke credit if you fail to make payment when due. If
payment
is not made when due, interest is payable at the rate of
3 per cent over Natwest then current base rate on the amount
outstanding
from the due date for payment until receipt by us of the
full
amount (including any accrued interest) whether before or
after judgment, together with any reasonable legal or other
recovery
costs.
If you pay by cheque, please allow 7-10 working days for your
cheque to clear.
Delivery
Unless you order and collect the goods from one of our trade
counters, we will deliver them in accordance with your order.
A valid signature will be required on collection or delivery.
It
is your responsibility or the responsibility of the person
that signs for the goods on your behalf to ensure that the
goods are in an undamaged condition.
If the goods have not
been signed for ‘damaged’ and
are subsequently found to be damaged, there will be no recall
to the carrier or to Spyder Air Ltd for replacement or compensation.
Upon delivery of the
goods to you, the goods shall be at your risk. In spite of
delivery having been made, title in the goods
shall not pass to you until you have paid the price for the
goods in full and no other sums whatsoever shall be due to
us from
you. Until title in the goods passes from us, you shall hold
the goods on a fiduciary basis as bailee and shall store
the goods at your own cost separately from all other goods
in your
possession and marked in such a way that they are clearly
identified as our property.
You must advise us by telephone within 24
hours of receipt, of any claim for short delivery or carriage,
goods signed for damaged
in transit or have been supplied incorrectly. If you do not
give notice within 24 hours, the goods will be deemed to
have been
delivered in the quantities shown in the delivery documents
and you shall not be entitled and will irrevocably and unconditionally
waive any right to reject the goods or claim damages for
short delivery.
Delays due to circumstances outside the control of the company
shall not entitle the purchaser to cancel an order or refuse
to accept delivery.
Delivery Overseas
Dispatch of overseas orders will commence upon receipt of a
bank draft, a direct bank transfer for goods ordered or as otherwise
agreed with the company.
While it is our aim to hold sufficient stock to meet all orders,
if we have insufficient stock to supply or deliver the goods
ordered and paid for by you, we may, at our discretion, supply
or deliver a substituted product or refund you the price paid
for such goods as soon as possible and in any case within 30
days or we may, in our absolute discretion, as soon as possible
raise a credit to offset the amount invoiced to you.
Returns and cancellation
You
may cancel your order by giving us notice of cancellation within
7 days of the date of delivery to you. Such notice must
be given by mail, fax or email. If you are canceling because
of any problem with the goods, please notify us of the problem
at the time of cancellation.
On cancellation for whatever reason, you must return the
goods to us at your cost. The goods must be returned in their
original
condition. Where the goods are being returned because they
are faulty or incorrect goods, we will meet the cost of return
provided
we use our nominated carrier. If orders that require design
and specialist manufacture are cancelled, the monies refunded
will reflect the cost of the design
and works carried out to the date of cancellation
Refunds will only be made on the credit or debit card that
was originally used to complete the transaction or cheque if
paid by cheque.
Returns Procedure for mail orders
Goods that have
been fitted or tampered with are NON-REFUNDABLE unless being
returned under Warranty.Refunds or replacements will not
be issued until the goods have been received and inspected
by Spyder Air Ltd. Where no refund or credit is due,
the goods can be collected by the customer, or sent back
to the customer at the customer’s
expense.
